I think you're a little confused here.

1. 日本語を話す。
- You're correct. I have the capability of speaking Japanese. (I speak Japanese)
2. 日本語を話している。
- You're correct. I am speaking Japanese now. (I am speaking Japanese)
3. 日本語で話す。
- You're wrong. It should be "I will speak in Japanese/ I speak with Japanese."
